Article 1:

this law aims at regulating production &importing of pesticides for Countries of Cooperation Council for the Arab States of the Gulf.

Definitions:

Article 2:

The following definitions and expressions are explained like this: Council:

Council: Countries of Cooperation Council for the Arab States of the Gulf .

Countries of Council: Countries of Cooperation Council for the Arab States of the Gulf .

General Secretary: General secretary of Cooperation Council for the Arab States of the Gulf .

Country: one of the Countries of Cooperation Council for the Arab States of the Gulf .

Ministry: ministry of agriculture or any ministry concerned with agricultural affairs at any country.

Minister: minister of agriculture.

Concerned authority: concerned authority of pesticides.

Law: Pesticides law For Countries of Cooperation Council for the Arab States of the Gulf .

Registration: the process of assessing scientific data that show activity and type of the pesticides into agricultural field and its efficiency into fighting pests that this pesticides is registered for fighting such pests, besides , verifying that such pesticides is not harmful or pose dangers on human beings , animal and environment .There shall be also verification of data label and checking that this product is registered into country of origin in raw material and final product cases that were the basic factor that importation license was approved or locally manufactured .Product shall be registered within concerned authorities records under certain No and registration certificate .

Pesticide: it is any chemical product that is used mainly for fighting pests and insects and either this pesticides was organic or non organic ,manufactured or natural or even biological that incorporate microorganisms elements.

Restricted pesticides: it is the pesticides that is enlisted in minister blacklist of restricted pesticides that represent a real danger effects I case of usage that aren’t allowed to be used unless accredited experts did this upon supervision of governmental authorities and such products aren’t allowed for dealings .

Banned pesticide: it is the pesticide that is enlisted in minister blacklist of banned pesticides that represent a real High toxicity to its adverse effect on the various elements of the environment and are not allowed negotiable.

Dealings : it denotes sale or storage or possession either permanently or temporally or transportation.

Importation: importing pesticides to the country either by mail packages or transportation or any other mean .

Pest: it is any biological species or any organism that is harmful on plants , animal or their products.

Executive regulation: it denotes executive regulation issued under herein law and its regulations.

Article 3:

Concerned authority take over registration procedures concerned with pesticides that are going to be imported or exported or for dealings or usage purposes.

Article4:

It isn't allowed to import or manufacturing or exchanging any pesticides until a license issuing from concerned authorities in state and according to rules and procedures stipulated under herein law and its executive regulation.

Article 5:

Minister upon suggestions and recommendations of concerned authorities is to take the following decisions:

  1. Banning usage of restricted pesticides that aren't allowed for importation , dealings or manufacturing purposes that is classified under "restricted pesticides".
  2. Putting conditions and procedures concerned with registration.
  3. Putting conditions and procedures of manufacturing, preparing , importation ,exportation and dealings of pesticides.
  4. Procedures concerned with samples taking and analyzing them ,besides procedures being followed when a re-judging claims are existed .
  5. Putting conditions and procedures usage of pesticides .
  6. Conditions concerned with advertising pesticides’s details and its data inclusive of dealings and recommendations conditions that has been issued by concerned authorities.
  7. Conditions required for pesticides’ disposal procedures that be with coordination with concerned authorities.

Article6:

Identifying concerned authority to deal with pesticides activities and required fees under herein law and its executive regulations.

Article 7:

Minister is authorized to allow importing restricted pesticides for academic research purposes and under conditions listed into executive regulations.

Article8:

Ministry is authorized to insect and check all of imports and exports and manufacturing details concerned with pesticides by its employees into agricultural departments and customs check points or any other individuals being assigned for such tasks and this is for verifying that law is abided by.

Article 9:

Official Employees are entitled to enter places , shops ,stores and corporations that deal with pesticides for ensuring that herein law is abided by and for issuing fines and contraventions for those who breached law.

Article 10:

Whoever do one of the following actions either directly or indirectly by an employee or agent ,is reckoned a violation of herein law :

  1. changing or disfiguring or damaging any of the data label details found on bottles .
  2. re-packaging bottles once again without formal approval by the concerned authorities .
  3. publicity and advertising for pesticides without prior approval from concerned authority.
  4. Not being cooperative with ministry appointed employees concerned with enforcing herein law and its regulations.
  5. Importing , exchanging or manufacturing any pesticides without issuing a license .
  6. Importing , exchanging or manufacturing any invalid pesticides or low quality .

Article 11:

Any country is free to fix required punitive procedures and fines for those who violate herein law and its executive regulations.

Article 12:

  1. Minister is entitled for issuing executive regulations concerned with herein law and amending them according to public interest requirements and under relevant international laws and conditions.
  2. General secretary must keep always updated by any issued executive regulations or any amendments to them .

Article 13:

Whoever see any prejudices incur him by decisions decreed in execution of herein law and its executive regulations , a complaint petition to be offered to the minister according to relevant applicable systems into each country.

Article 14:

Any amendments to herein law must be in coordination with membership countries and shall not be applicable unless being approved first by supreme council and in case of enforcing such amendments ,stipulated procedures within article 15 shall be enforcing as well.

Article 15:

Herein law are to be abided by compulsorily and shall be applicable within 6 months by supreme council.
